PROPOSED ADMENDMENTS


AMENDMENT 1.  Remove the Statement that State Singles Tournament will not count as one of the tournaments for the next year.

 

 

Reason:  The State Singles Tournament is a sanctioned tournament and should count toward the qualifications of pitching four sanctioned Texas tournaments to enter the next year’s tournament.  Would read as:

 

ARTICLE XIII – STATE SINGLES TOURNAMENT

 

SECTION 1.    All members must have pitched in four (4) Texas sanctioned tournaments since the previous year “cut-off” tournament date in order to be eligible to pitch in the State singles Tournament.  Includes all State Tournaments.

 

 

ADMENDMENT 2. Change the number of courts to host a State Singles Tournament to 20 courts.

 

Reason:   To increase the number of clubs eligible to host the State Singles throughout the State from four (4) (Waco, Bryan, Kilgore and Buffalo) to eight (8) (East Bernard, Houston, San Antonio, Arlington, Waco, Bryan, Kilgore, and Buffalo).  It will also allow new clubs and existing clubs to negotiate with increased probability of assistance with cities and counties due to the difference in land and money required for fewer courts and to state they will have ability to host a State Singles Tournament.  Without a large increase in the number of entries during the past four years, 20 courts are enough to pitch the State Singles Tournament.  Would read as:

SECTION 7. B. Have a minimum of 20 courts completed and sanctioned at the time of selection.

 

 

 

ADMENDMENT 3.   Change a quorum of the Executive Board to be one half plus one of the numbers of officers.

 

Reason:  To have a statement of how to determine a quorum instead of a number.  This will avoid changing the by-law each time an office is vacated or deleted.  Would read as:

 

ARTICLE VIII – EXECUTIVE BOARD

 

SECTION 2: A quorum shall one half plus one of the offices being held at any given time.

 

 

 

 

AMENDMENT 4.  Remove  Article VIII – Executive Board, Section 1, D which states the results of any and all voting by the board in closed session, i.e.(phone, e-mail, closed meetings, etc) shall be forwarded to the Editor for printing in the next issue of the Ringer.  The results shall include how each officer voted on any motion.

 

Reason: In conflict with Robert’s Rules.  Closed session may only be called for specific reasons such as disciplinarily or legal action. All other minutes of officer’s and/or general meetings are already printed in the Ringer and posted on the Web Site. 

 

 

AMENDEMENT 5.  Change Article IX – Election of Officers, Section 1. Voting, B to remove voting at the State Singles Tournament and on-line votes. Voting by U.S. mail only. 

 

Reason:  Voting at the State Singles did not increase the total number of votes.   The amount of time to count the mail votes prior to opening the voting booth at the State Singles, the time and people to man the booth and count the votes, etc. is excessive.  The process of voting at the State Singles takes three to four people away from over half of the activities of the State Singles.  The mailed ballots would continue to be opened and counted at the State Singles Tournament by the Advisory Board members prior to the General Meeting on Friday evening where the results would be announced.

ARTICLE IX – ELECTION OF OFFICERS

SECTION 1.    Voting

B. Voting shall be by U.S. postal mail only.  All ballots must be postmarked 14 days prior to the State Singles Tournament.  All ballots will be brought to the tournament unopened where the presiding officer and the members of the Advisory Committee will open all ballots.  Prior to counting, they will verify all ballots by paid membership and check for duplicate ballots.  The results will be announced at the General Meeting.  Any person running for office will not be able to participate in the handling and/or counting of the votes.

 

 

AMENDMENT 6.   Remove Article XVII – Awards

 

Reason:  The Article is unclear as to how the voting would take place.  It also limits a pitcher from being nominated by anyone outside of their geographic division.  It is felt the one sportsmanship award for the State that the President has awarded for several years should remain in effect.  This award is decided with pitchers from throughout the state giving input.

Correct Article XVI – Amendment to By-laws, D.  (No vote required) 

 

Reason:  Our by-laws are in conflict with Robert Rules which overrides our by-laws. Would read:

 

D.   A 2/3 majority is required to pass an amendment.

  

 

 

 

 AMENDMENT 7: Change Article IX – Election of Officers, Section 2, E to change immediate family to same household.

 

Reason:  To allow immediate family that is not and has not been living in the same house to run for office. Such as parents and grown children. Would read:

 

E. Members of the same household may not hold office at the same time.

AMENDMENT 8: ARTICLE VIII, Ex. Board,

D. Members must be informed by the Ringer and web page of votes taken by the Ex. Board.  This info must contain what was voted on and how each officer voted.  The only exception would be any disciplinary action that the board has to take.

 

 

AMENDMENT  9: Article XI, Meetings Delegates.

Sec. 1 (change) All officers are required to attend 2 meetings a year.  (State Singles and State Doubles)

 

AMENDMENT 10.  Article XI, Meetings Delegates

Sec. 2 (change) In order to vote the President (delegate) of each club must be present to vote or send a written nominee from his club to vote in his/her absence.  This written nominee must be submitted to the President and Editor 7 days before any meeting.

 

 

AMENDMENT 11. Article XI, Meetings Delegates

4. (New) The attending officers and club presidents or written alternate and elected and appointed independent delegates will be the only ones allowed to vote at any charter meeting.

 

 

AMENDMENT 12.  Article XIII State Singles

Sec. 7 (change) To be eligible to host the state singles tournament courts must be sanctioned for 2 years. (No PORTABLE COURTS WILL BE ALLOWED).

AMENDMENT 15.     ARTICLE XV, Travel Fund

Sec. 1 A. (change) the travel fund will be utilized by all officers.  The president in required to attend the State Singles, State Doubles and one tournament in each division for a total of 6 tournaments.  The President will be compensated $150.00 per tournament for a total of $900.00 per year. 

All other officers are required to attend the Sate Singles Championship and State Doubles Championship.  They will be paid $150.00 for each State tournament that they attend.  Officers must travel at least 50 miles to receive compensation.  If these available amounts exceed the travel fund income then the money will be taken from the gen. fund.


 

AMENDMENT 16.  ARTICLE XV, Travel Fund

D. (new) all officers must pitch in these required tournaments in order to receive compensation.

 

 

AMENDMENT 17.  ARTICLE XVI, AMMENDMENTS

Sec. 1

a. (Change), Proposed amendments must be received by the President and Editor on or before June 1 of the current year.  Theses amendments must be accompanied by a name of a THPA member.  This name(s) will be published with the purposed changes.

 

 

 

AMENDMENT 18. ARTICLE XIII State Singles

Section 6.  The State Singles Tournament location will be on a rotation basis of Waco, Buffalo, and Bryan.  These clubs may not host back to back State Tournaments unless the other clubs pass.
